Medical Malpractice

What are cases of medical malpractice? These are situations in which a hospital, nurse, or doctor—whether a surgeon, anesthesiologist, pediatrician, dentist, etc.—causes harm to a patient by performing their duties without adhering to the precautions required by the medical profession. This can involve gross negligence, omissions, or actions that result in a medical condition. In all such cases, it is possible to take legal action against the hospital and/or medical personnel to seek compensation for the harm caused. The injured party, or in tragic cases where the patient loses their life, the patient’s heirs, may pursue a claim.

A medical expert is appointed to prepare a technical report, which details the actions taken, the causal link, and the resulting event, while also quantifying the damage.

Out-of-Court Phase
A formal letter is sent to the responsible parties, describing the incident, stating the claim for compensation, and allowing time to settle the matter amicably.

Judicial Phase
If the out-of-court phase fails, we proceed with legal action, presenting the documentation, expert report, and claims using the fastest legal avenues available.


How Long Does It Take?

As quickly as possible. The key is to work thoroughly from the start, gathering all necessary materials for both phases and choosing the procedure that best meets the client’s needs.

How Much Does It Cost?

Up to the out-of-court phase, only the possible costs of the expert report. After that, costs for legal stamps, court fees, and potential expert witness fees may apply. The lawyer’s fees, however, are only paid at the end, and only if we win the case.
